When Minuk Digital provides marketing services to a client, that client is responsible for the personal information in their own systems, and Minuk Digital acts on their instructions as a service provider. This policy covers information collected for our own purposes through this website.
2. Information we collect
Information you give us. When you submit the contact form or request a free digital audit, we collect your name, your email address, your business name if you provide it, your phone number if you provide it, the service you are interested in, and anything else you write in the message field.
Form submissions are handled by Netlify, our website host, which stores a copy of each submission and emails it to our business inbox on Google Workspace. We do not currently keep enquiries in a customer relationship management system.
If you become a client, we also collect information needed to deliver and bill for our services, such as billing contact details, account access credentials you choose to share with us, and correspondence. Invoicing and payment records are held in our accounting software. If you pay by electronic funds transfer or Interac e-Transfer, your bank and ours handle that transaction and we receive only the payment confirmation.
Information collected automatically. When you visit the site we and our service providers may collect your IP address and approximate location, usually at the city level; browser, device and operating system; pages viewed, time on page and links clicked; the website, ad or search that referred you; the date and time of your visit; and cookie identifiers as described in section 5.
We do not knowingly collect personal information from anyone under 18 through this website, and we do not buy contact lists.
3. Why we collect it
To respond to your enquiry and provide a quote or audit; to deliver, support and improve the services you have engaged us for; to send invoices and process payments; to send marketing emails where you have consented or where we have an existing business relationship under CASL; to measure how the website performs; to detect and prevent fraud, abuse and security incidents; and to meet our legal, tax and record-keeping obligations.
Under PIPEDA we rely on your consent, which may be express or implied depending on the sensitivity of the information and the purpose. You can withdraw consent at any time, subject to legal and contractual limits, using the contact details in section 1.
4. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioural advertising by third parties for their own purposes.
Service providers who process information on our behalf. As of the date at the top of this page these are:
- Netlify for website hosting and for receiving and storing contact form submissions
- Google Workspace for our email, calendar and document storage
- Google for website analytics, through Google Tag Manager and Google Analytics 4
- Wave for invoicing and payment processing
- Google Fonts, which serves the typefaces on this site and receives your IP address when a page loads
They are permitted to use the information only to provide services to us. We will update this list as our tools change.
We also share information with professional advisors such as our accountant or legal counsel where needed; with authorities or other parties where required or permitted by law, to enforce our agreements, or to protect the rights, safety and property of Minuk Digital or others; and with a successor if the business is sold, merged, incorporated or reorganized, subject to that successor honouring this policy.
Information stored outside Canada. Several of these providers store and process data in the United States and other countries. While information is in another country it may be accessible to the courts, law enforcement and national security authorities of that country. We use providers that offer comparable protection through contractual and technical safeguards.
5. Cookies, tracking and advertising
Strictly necessary. Needed for the site to work, including security and basic form functionality. These cannot be turned off through our site.
Analytics. We use Google Analytics 4, loaded through Google Tag Manager, to understand how visitors find and use the site, which pages perform, and where people leave. This is reported to us in aggregate. Google may use this data in accordance with its own privacy policy.
Advertising. We do not currently run advertising or remarketing tags on this website. If that changes we will update this section before the tags go live.
As of the date at the top of this page, the complete list of third parties that receive data when you load a page here is: Netlify (hosting), Google Tag Manager and Google Analytics 4 (analytics), and Google Fonts (typefaces).
Your choices. Most browsers let you block or delete cookies, though blocking all cookies may break parts of the site. You can opt out of personalized Google advertising at My Ad Center and out of Google Analytics with the browser add-on. Industry opt-out tools include YourAdChoices in Canada and the Digital Advertising Alliance.
Browsers send a Do Not Track signal inconsistently and there is no common standard for responding to it, so this site does not currently respond to it. Where required, we honour Global Privacy Control signals.
6. Email marketing and CASL
We send commercial email only where you have given express consent, or where we have implied consent under CASL, such as an existing business relationship or an enquiry you sent us.
Every commercial email we send identifies Minuk Digital, includes our mailing address and a way to contact us, and includes a one-click unsubscribe link that works for at least 60 days. Unsubscribe requests are honoured within 10 business days, and usually immediately. You can also unsubscribe by emailing jorel@minukdigital.com.
Unsubscribing from marketing does not stop transactional messages such as invoices, project updates, or replies to your enquiry.
7. How long we keep information
- Enquiries that do not become clients. Kept in our email inbox and in the Netlify form store for up to 24 months from last contact, then deleted from both.
- Client records and correspondence. For the term of the engagement, then as long as the related financial records.
- Financial and tax records. Six years from the end of the last tax year they relate to, which is the Canada Revenue Agency requirement.
- Analytics identifiers. Per the retention settings of the platform, typically 2 to 26 months.
When information is no longer needed we delete it or make it anonymous.
8. How we protect information
We use reasonable safeguards appropriate to the sensitivity of the information, including encrypted connections, access controls and multi-factor authentication on business accounts, password management, limiting access to people who need it, and vetting our service providers.
No method of transmission or storage is completely secure. If a breach creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as PIPEDA requires.
9. Your rights
You can access the personal information we hold about you and ask how it has been used and disclosed; correct information that is inaccurate or incomplete; withdraw consent to some or all uses, subject to legal and contractual limits; ask us to delete information where we are not required to keep it; and complain if you think we have mishandled your information.
Email jorel@minukdigital.com with your request. We will confirm your identity and respond within 30 days. There is no charge for a reasonable request. If we need more time or must refuse part of a request, we will tell you why.
If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada at priv.gc.ca or 1-800-282-1376.
10. Regional rights
Quebec. Law 25 gives you additional rights, including data portability and the right to be informed when a decision about you is made solely by automated processing. We do not make such decisions about website visitors.
European Economic Area and United Kingdom. You have rights of access, rectification, erasure, restriction, portability and objection, including objection to processing for direct marketing, and you can complain to your local supervisory authority.
United States. Residents of states with privacy laws may have rights to know, delete, correct, and opt out of sale or sharing of personal information. We do not sell personal information or share it for cross-context behavioural advertising as those terms are defined in those laws, and we will not discriminate against you for exercising a right.
11. Links to other sites
This site links to other websites, including client sites, social profiles and tools we recommend. We are not responsible for their content or their privacy practices. Read their policies before giving them your information.
12. Changes to this policy
We may update this policy as our practices, tools or the law change. The effective date at the top of this page shows when it last changed. Material changes will be posted here, and where required we will ask for your consent again.
